Cadrul legal al acestui program este Ordonan\u0163a de urgen\u0163\u0103 a Guvernului nr. 60\/2009 \u015fi normele de aplicare aprobate prin Hot\u0103r\u00e2rea Guvernului nr. 717\/2009.<\/p>\n<p style=\"text-align: justify;\">&#8220;<em>Prin locuin\u0163\u0103 \u00een sensul programului \u00abPrima cas\u0103\u00bb se \u00een\u0163elege orice imobil cu destina\u0163ia de locuin\u0163\u0103, alc\u0103tuit din una sau mai multe camere de locuit, cu terenul, c\u0103ile de acces, anexele gospod\u0103re\u015fti, facilit\u0103\u0163ile, dependin\u0163ele, dot\u0103rile \u015fi utilit\u0103\u0163ile, aferente acesteia, care satisface cerin\u0163ele de locuit ale unei persoane sau familii<\/em>&#8220;, prevede ordonan\u021ba.<\/p>\n<h2 style=\"text-align: justify; padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong>Care este mecanismul programului\u00a0<\/strong><strong>&#8220;Prima Cas\u0103&#8221;<\/strong><strong>?<\/strong><\/span><\/h2>\n<p style=\"text-align: justify;\">Programul &#8220;Prima cas\u0103&#8221;\u00a0este un program guvernamental, care se deruleaz\u0103 prin intermediul\u00a0FNGCIMM \u0219i care are dou\u0103 componente, adic\u0103 st\u0103 la dispozi\u021bia persoanelor fizice, cu dou\u0103 op\u021biuni:<\/p>\n<p style=\"text-align: justify;\"><strong>a) Achizi\u021bia unei locuin\u021be<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>b) Contruirea unei locuin\u021be<\/strong><\/p>\n<p style=\"text-align: justify; padding-left: 30px;\"><strong>a) Programul \u201ePrima cas\u0103\u201d &#8211; <strong> <span style=\"text-decoration: underline;\">ACHIZI\u021aII<\/span> <\/strong><\/strong><\/p>\n<p style=\"text-align: justify;\">FNGCIMM garanteaz\u0103 \u00een numele \u015fi \u00een contul statului, \u00een mod direct, expres, irevocabil \u015fi necondi\u0163ionat, obliga\u0163iile de rambursare a finan\u0163\u0103rilor acordate de Finan\u0163ator beneficiarilor eligibili, \u00een limita unui plafon de garantare.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\"><strong>Documente necesare pentru <span style=\"text-decoration: underline;\">ACHIZI\u021aII<\/span> prin\u00a0\u201ePrima cas\u0103\u201d<\/strong><\/p>\n<p><strong>pentru beneficiarii care\u00a0achizi\u021bioneaz\u0103 o singur\u0103 locuin\u0163\u0103 \u00een regim individual:<\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\">solicitarea de garantare semnat\u0103 \u015fi \u015ftampilat\u0103 de finantator, dupa aprobarea finantarii;<\/li>\n<li style=\"text-align: justify;\">documentul de identitate al beneficiarului\/beneficiarilor, precum \u015fi al so\u0163ului \/so\u0163iei, dac\u0103 este\/sunt c\u0103s\u0103torit\/c\u0103s\u0103tori\u0163i, \u00een copie certificat\u0103;<\/li>\n<li style=\"text-align: justify;\">\u00a0declara\u0163ia pe propria r\u0103spundere a beneficiarului;<\/li>\n<li style=\"text-align: justify;\">\u00a0antecontractul de v\u00e2nzare-cump\u0103rare autentificat, \u00een copie certificat\u0103;<\/li>\n<li style=\"text-align: justify;\">extras de carte funciar\u0103 privind locuin\u0163a ce urmeaz\u0103 s\u0103 fie achizi\u0163ionat\u0103 din finan\u0163are, eliberat cu cel mult 15 zile \u00eenainte de data solicit\u0103rii de garantare, \u00een original, actualizat \u00een ceea ce prive\u015fte datele de identificare ale imobilului;<\/li>\n<li style=\"text-align: justify;\">certificatul de eficien\u0163\u0103 energetic\u0103 pentru una dintre clasele A, B sau C de eficien\u0163\u0103 energetic\u0103, \u00eencep\u00e2nd cu data intr\u0103rii \u00een vigoare a prevederilor art. 23 din <strong>Legea nr. 372\/2005<\/strong>, cu modific\u0103rile ulterioare, \u00een copie certificat\u0103 pentru conformitate cu originalul.<\/li>\n<\/ul>\n<h2 style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">Cine poate beneficia de programul\u00a0<strong>\u00a0\u201ePrima cas\u0103\u201d \u0219i care sunt condi\u021biile?<\/strong><\/span><\/h2>\n<p>Criteriile de eligibilitate pentru beneficiarii care <strong>achizi\u0163ioneaz\u0103 locuin\u0163e<\/strong> prin Programul Prima Casa sunt urm\u0103toarele:<\/p>\n<ul>\n<li style=\"text-align: justify;\">fac dovada cu declara\u0163ia autentic\u0103 pe propria r\u0103spundere c\u0103 \u00eendeplinesc condi\u0163ia prev\u0103zut\u0103 la art. 1 alin. (2) din <strong>Ordonan\u0163a de urgen\u0163\u0103 a Guvernului nr. 60\/2009<\/strong>, aprobat\u0103 cu modific\u0103ri \u015fi complet\u0103ri prin <strong>Legea nr. 368\/2009<\/strong>, cu modific\u0103rile \u015fi complet\u0103rile ulterioare;<\/li>\n<li style=\"text-align: justify;\">achizi\u0163ioneaz\u0103 \u00een cadrul Programului o singur\u0103 locuin\u0163\u0103 finalizat\u0103, aflat\u0103 pe teritoriul Rom\u00e2niei, \u00eenscris\u0103 \u00een cartea funciar\u0103 \u00een condi\u0163iile legii;<\/li>\n<li style=\"text-align: justify;\">dispun de un avans de minimum <strong>5%<\/strong> din pre\u0163ul de achizi\u0163ie a locuin\u0163ei \u015fi\/sau care acoper\u0103 diferen\u0163a dintre pre\u0163ul de achizi\u0163ie a locuin\u0163ei rezultat din antecontractul de v\u00e2nzare-cump\u0103rare \u015fi finan\u0163area garantat\u0103;<\/li>\n<li style=\"text-align: justify;\">\u00eendeplinesc condi\u0163iile specifice prev\u0103zute \u00een cadrul normelor interne de creditare ale finan\u0163atorilor;<\/li>\n<li style=\"text-align: justify;\">se oblig\u0103 s\u0103 constituie un depozit colateral pentru garantarea dob\u00e2nzii, \u00een valoare egal\u0103 cu 3 rate de dob\u00e2nd\u0103, valabil pe \u00eentreaga durat\u0103 a finan\u0163\u0103rii;<\/li>\n<li style=\"text-align: justify;\">se oblig\u0103 s\u0103 nu \u00eenstr\u0103ineze locuin\u0163a achizi\u0163ionat\u0103 \u00een primii 5 ani de la data dob\u00e2ndirii. Dup\u0103 expirarea acestui termen, \u00een cazul prelu\u0103rii contractului de credit de c\u0103tre un ter\u0163, acesta trebuie s\u0103 \u00eentruneasc\u0103 criteriile de eligibilitate a beneficiarilor Programului;<\/li>\n<li style=\"text-align: justify;\">locuin\u0163a care se achizi\u0163ioneaz\u0103 \u00een cadrul Programului se \u00eencadreaz\u0103 \u00een una dintre clasele A, B sau C de eficien\u0163\u0103 energetic\u0103, condi\u0163ie aplicabil\u0103 \u00eencep\u00e2nd cu data intr\u0103rii \u00een vigoare a prevederilor art. 23 din <strong>Legea nr. 372\/2005 <\/strong>privind performan\u0163a energetic\u0103 a cl\u0103dirilor, cu modific\u0103rile ulterioare.<br \/>\n<hr \/>\n<\/li>\n<\/ul>\n<p style=\"padding-left: 30px;\"><strong>b) Programul \u201ePrima cas\u0103\u201d &#8211; <strong><span style=\"text-decoration: underline;\">CONSTRUIRE<\/span><\/strong><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>FNGCIMM<\/strong> garanteaz\u0103 \u00een numele \u015fi \u00een contul statului, \u00een mod direct, expres, irevocabil \u015fi necondi\u0163ionat, obliga\u0163iile de rambursare a finan\u0163\u0103rilor acordate de Finan\u0163ator beneficiarilor eligibili, \u00een limita unui plafon de garantare.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\"><strong>Documente necesare pentru <span style=\"text-decoration: underline;\">CONSTRUIRE<\/span>\u00a0prin\u00a0\u201ePrima cas\u0103\u201d<\/strong><\/p>\n<p><strong>Pentru beneficiarii care construiesc o singur\u0103 locuin\u0163\u0103 \u00een regim individual:<\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\">solicitarea de garantare semnat\u0103 \u015fi \u015ftampilat\u0103 de finantator, dupa aprobarea finantarii;<\/li>\n<li style=\"text-align: justify;\">documentul de identitate al beneficiarului\/beneficiarilor, precum \u015fi al so\u0163ului\/so\u0163iei, dac\u0103 este\/sunt c\u0103s\u0103torit\/c\u0103s\u0103tori\u0163i, \u00een copie certificat\u0103;<\/li>\n<li style=\"text-align: justify;\">declara\u0163ia pe propria r\u0103spundere a beneficiarului\/beneficiarilor;<\/li>\n<li style=\"text-align: justify;\">extras de carte funciar\u0103 privind terenul pe care urmeaz\u0103 s\u0103 se construiasc\u0103 locuin\u0163a, \u00een care s\u0103 fie notat\u0103 autoriza\u0163ia de construire, \u00een original.<\/li>\n<\/ul>\n<p><strong>Pentru beneficiarii constitui\u0163i \u00een asocia\u0163ii f\u0103r\u0103 personalitate juridic\u0103, alc\u0103tuite din minimum 2 beneficiari<\/strong>, care construiesc o singur\u0103 locuin\u0163\u0103 pentru fiecare dintre ace\u015ftia:<\/p>\n<ul>\n<li style=\"text-align: justify;\">solicitarea de garantare semnat\u0103 \u015fi \u015ftampilat\u0103 de finantator dupa aprobarea finantarii;<\/li>\n<li style=\"text-align: justify;\">documentul de identitate pentru fiecare beneficiar membru al asocia\u0163iei, precum \u015fi al so\u0163ului\/so\u0163iei fiec\u0103ruia, \u00een copie certificat\u0103;<\/li>\n<li style=\"text-align: justify;\">declara\u0163ia pe propria r\u0103spundere pentru fiecare beneficiar membru al asocia\u0163iei;<\/li>\n<li style=\"text-align: justify;\">extras de carte funciar\u0103 privind terenul pe care urmeaz\u0103 s\u0103 se construiasc\u0103 locuin\u0163a, \u00een care s\u0103 fie notat\u0103 autoriza\u0163ia de construire, \u00een original, actualizat \u00een ceea ce prive\u015fte datele de identificare ale imobilului.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>\u00a0 \u00a0 \u00a0C\u00e2\u021bi bani po\u021bi primi\u00a0\u00een 2017, prin programul \u201ePrima cas\u0103\u201d ?<\/strong><\/p>\n<p style=\"text-align: justify;\">Persoanele care se \u00eenscriu \u00een Programul Prima Cas\u0103, \u00een 2017, pot beneficia de \u00a0\u00eemprumuturi maximum\u00a0<strong>57 de mii de euro<\/strong> pentru locuin\u0163e vechi \u015fi <strong>66 de mii de euro<\/strong> pentru cele noi. Garan\u0163ia oferit\u0103 de stat pentru b\u0103nci este de 40% din pre\u0163ul unei locuin\u0163e vechi \u015fi 60% din cele noi.<\/p>\n<h2 style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">Cine poate beneficia de programul\u00a0<strong>\u00a0\u201ePrima cas\u0103\u201d- contruire.<\/strong><\/span><\/h2>\n<p><strong>Criteriile de eligibilitate pentru beneficiarii individuali<\/strong> sunt urm\u0103toarele:<\/p>\n<p style=\"text-align: justify;\">a)\u00a0fac dovada cu declara\u0163ia autentic\u0103 pe propria r\u0103spundere c\u0103 \u00eendeplinesc condi\u0163ia prev\u0103zut\u0103 la art. 1 alin. (2) din Ordonan\u0163a de urgen\u0163\u0103 a Guvernului nr. 60\/2009, aprobat\u0103 cu modific\u0103ri \u015fi complet\u0103ri prin Legea nr. 368\/2009, cu modific\u0103rile \u015fi complet\u0103rile ulterioare;<\/p>\n<p style=\"text-align: justify;\">b)\u00a0au \u00een proprietate terenul pe care se construie\u015fte locuin\u0163a, inclusiv \u00een cazul celor construite prin A.N.L., \u00eenscris \u00een cartea funciar\u0103 \u00een condi\u0163iile legii, liber de orice sarcini, \u015fi se oblig\u0103 s\u0103 garanteze cu acesta, precum \u015fi cu locuin\u0163a construit\u0103 din finan\u0163area garantat\u0103 \u00een condi\u0163iile Programului;<\/p>\n<p style=\"text-align: justify;\">c)\u00a0prezint\u0103 Finan\u0163atorului proiectul tehnic \u015fi detaliile de execu\u0163ie a locuin\u0163ei, \u00eentocmite conform legii;<\/p>\n<p style=\"text-align: justify;\">d)\u00a0de\u0163in o autoriza\u0163ie de construire a locuin\u0163ei \u00een cadrul Programului valabil\u0103, eliberat\u0103 conform legii dup\u0103 data de 22 februarie 2010, precum \u015fi avizele \u015fi acordurile necesare conform legii;<\/p>\n<p style=\"text-align: justify;\">e)\u00a0prezint\u0103 Finan\u0163atorului un contract de antrepriz\u0103 \u00eencheiat cu o societate de construc\u0163ii, \u00een calitate de antreprenor general al imobilului, \u00een baza c\u0103ruia solicit\u0103 acordarea finan\u0163\u0103rii garantate, precum \u015fi estim\u0103rile costurilor necesare pentru edificarea locuin\u0163ei, conform devizului estimativ al lucr\u0103rilor, anex\u0103 la contract. Din contractul de antrepriz\u0103\/graficul de lucr\u0103ri anexat la acesta trebuie s\u0103 rezulte c\u0103 durata realiz\u0103rii construc\u0163iei este de maximum 18 luni de la data efectu\u0103rii primei trageri din finan\u0163area garantat\u0103;<\/p>\n<p style=\"text-align: justify;\">f)\u00a0prev\u0103d \u00een contractul de antrepriz\u0103 obliga\u0163ia antreprenorului general de a finaliza construc\u0163ia locuin\u0163ei \u00een termen de cel mult 18 luni de la data efectu\u0103rii primei trageri din finan\u0163area garantat\u0103. Contractul poate fi modificat, \u00een sensul prelungirii termenului cu cel mult 12 luni;<\/p>\n<p style=\"text-align: justify;\">g) prezint\u0103 Finan\u0163atorului certificatul de atestare fiscal\u0103 eliberat la cererea constructorului, care atest\u0103 \u00eemprejurarea c\u0103 acesta nu \u00eenregistreaz\u0103 restan\u0163e mai mari de 60 de zile la plata obliga\u0163iilor fa\u0163\u0103 de bugetul general consolidat;<\/p>\n<p style=\"text-align: justify;\">h)\u00a0prezint\u0103 Finan\u0163atorului poli\u0163a de asigurare a lucr\u0103rilor de construc\u0163ii-montaj pentru imobilul cu destina\u0163ia de locuin\u0163\u0103 aflat \u00een construc\u0163ie, \u00eencheiat\u0103 cu o societate de asigurare agreat\u0103 de Finan\u0163ator, av\u00e2nd ca beneficiar statul rom\u00e2n, reprezentat prin Ministerul Finan\u0163elor Publice, pe toat\u0103 durata de execu\u0163ie a lucr\u0103rilor;<\/p>\n<p style=\"text-align: justify;\">i)\u00a0prezint\u0103 Finan\u0163atorului dovada constituirii de c\u0103tre constructor a unei garan\u0163ii de bun\u0103 execu\u0163ie de 10% din valoarea total\u0103 a devizului estimativ de lucr\u0103ri, sub forma unei scrisori de garan\u0163ie bancar\u0103 de bun\u0103 execu\u0163ie;<\/p>\n<p style=\"text-align: justify;\">j)\u00a0prezint\u0103 Finan\u0163atorului contractul valabil \u00eencheiat cu un diriginte de \u015fantier autorizat. Criteriul este aplicabil \u00een cazurile \u00een care angajarea unui diriginte de \u015fantier este obligatorie potrivit legii;<\/p>\n<p style=\"text-align: justify;\">k)\u00a0\u00eendeplinesc condi\u0163iile specifice prev\u0103zute \u00een cadrul normelor interne de creditare ale finan\u0163atorilor;<\/p>\n<p style=\"text-align: justify;\">l)\u00a0dispun de un aport propriu de minimum 5% din valoarea costului de construire a locuin\u0163ei, care acoper\u0103 diferen\u0163a dintre valoarea din contractul de antrepriz\u0103 \u015fi finan\u0163area garantat\u0103;<\/p>\n<p style=\"text-align: justify;\">m)\u00a0se oblig\u0103 s\u0103 constituie un depozit colateral pentru garantarea dob\u00e2nzii, \u00een valoare egal\u0103 cu 3 rate de dob\u00e2nd\u0103;<\/p>\n<p style=\"text-align: justify;\">n)\u00a0se oblig\u0103 s\u0103 nu cesioneze drepturile de construire \u015fi s\u0103 nu \u00eenstr\u0103ineze terenul \u015fi locuin\u0163a construit\u0103 prin Program \u00een primii 5 ani de la data instituirii ipotecii legale. \u00cen cazuri temeinic justificate, Ministerul Finan\u0163elor Publice poate aproba preluarea finan\u0163\u0103rii garantate \u015fi a locuin\u0163ei de c\u0103tre o persoan\u0103 fizic\u0103 ce \u00eendepline\u015fte criteriile de eligibilitate \u00een cadrul Programului;<\/p>\n<p style=\"text-align: justify;\">o) se oblig\u0103 s\u0103 noteze autoriza\u0163ia de construire \u00een cartea funciar\u0103 a terenului;<\/p>\n<p style=\"text-align: justify;\">p)\u00a0se oblig\u0103 s\u0103 asigure locuin\u0163a finalizat\u0103, construit\u0103 din finan\u0163area garantat\u0103, \u00eempotriva tuturor riscurilor \u015fi desemneaz\u0103 statul rom\u00e2n, reprezentat de Ministerul Finan\u0163elor Publice, ca beneficiar al poli\u0163ei de asigurare a locuin\u0163ei, p\u00e2n\u0103 la \u00eendeplinirea tuturor obliga\u0163iilor fa\u0163\u0103 de Finan\u0163ator;<\/p>\n<p style=\"text-align: justify;\">q) se oblig\u0103 s\u0103 acopere din surse proprii eventualele costuri rezultate, suplimentare fa\u0163\u0103 de cele din devizul estimativ;<\/p>\n<p style=\"text-align: justify;\">r) se oblig\u0103 s\u0103 efectueze pe cheltuiala proprie formalit\u0103\u0163ile de notare a autoriza\u0163iei de construire \u00een cartea funciar\u0103;<\/p>\n<p style=\"text-align: justify;\">s) se oblig\u0103 s\u0103 efectueze pe cheltuiala proprie toate formalit\u0103\u0163ile necesare \u00eenscrierii \u00een cartea funciar\u0103 a locuin\u0163ei individuale, dup\u0103 finalizarea acesteia, \u015fi s\u0103 prezinte Finan\u0163atorului documentele necesare \u00een vederea \u00eenscrierii ipotecilor legale \u00een cartea funciar\u0103.<\/p>\n<p style=\"padding-left: 30px;\"><strong>Criteriile de eligibilitate pentru beneficiarii care construiesc o locuin\u0163\u0103 prin asocia\u0163ii f\u0103r\u0103 personalitate juridic\u0103 constituite de minimum 2 beneficiari<\/strong> sunt urm\u0103toarele:<\/p>\n<p>a)\u00a0\u00a0\u00a0fac dovada cu declara\u0163ia autentic\u0103 pe propria r\u0103spundere c\u0103 \u00eendeplinesc condi\u0163iile prev\u0103zute la art. 1 alin. (2) din Ordonan\u0163a de urgen\u0163\u0103 a Guvernului nr. 60\/2009, aprobat\u0103 cu modific\u0103ri \u015fi complet\u0103ri prin Legea nr. 368\/2009, cu modific\u0103rile \u015fi complet\u0103rile ulterioare;<\/p>\n<p>b) fiecare dintre membrii asocia\u0163iei este beneficiar al Programului \u015fi \u00eendepline\u015fte toate criteriile de eligibilitate prev\u0103zute la art. 3.1 alin. (1), cu excep\u0163ia \u00eendeplinirii criteriului prev\u0103zut la art. 3.1 alin.
